CarePay is a company based in Kenya that facilitates healthcare payments between funders, patients, and healthcare providers through the M-TIBA platform. Funds are directed from both public and private sources directly to patients' 'health wallets' on their mobile phones.



MAIN PURPOSE OF THE JOB:
As the Legal & Privacy Counsel at CarePay / M-TIBA, your role is crucial in providing legal and data privacy support across various functions of the business. In Kenya, you will collaborate with commercial and operational teams to handle contract agreements with partners and provide regulatory guidance. Additionally, you will work with the global Compliance team on legal and data-related matters for the CarePay group.

KEY RESPONSIBILITIES

LEGAL:
- Contract negotiation with partners (such as payers and healthcare providers), drafting general terms and conditions, and creating contract templates for CarePay's platform and services.
- Offering legal advice on regulations impacting the business, including health insurance and payment laws.
- Developing policies, processes, and conducting employee trainings to ensure business teams are empowered for compliance and growth.
- Handling procurement, vendor relationships, including IT supplier contracts, and insurance policies.
- Managing contracts, corporate governance, and general housekeeping.

DATA:
- Structuring data processing agreements with partners and intra-group, conducting privacy impact assessments, and maintaining a data processing register.
- Providing guidance on data privacy regulations in different jurisdictions such as East Africa, EU, and MENA.
- Creating data protection policies, statements, conducting trainings, and facilitating compliance and growth within the business.
- Overseeing interactions with regulators, partners, and data subjects, including audits and reporting.

REQUIREMENTS

EDUCATIONAL QUALIFICATIONS & WORKING EXPERIENCE:
- Possess a university degree in relevant fields such as Private Law, Information Law, Cyber Security, or Computer Science.
- Completed legal courses in contracting, IT/IP, compliance, data protection, privacy, and health insurance.
- Minimum of 6-8 years of relevant work experience, with at least 3 years dedicated to legal and data matters.
- Previous experience at a top-tier international advisory firm and as an in-house counsel.

KEY SKILLS AND COMPETENCIES:
- Act as a trusted advisor to the business with the ability to analyze problems efficiently and provide practical advice considering both legal requirements and business objectives.
- Maintain a strategic perspective while paying attention to details, understanding how legal aspects fit into the broader business context.
- Proficient in reviewing and drafting contracts, policies, resolutions, and other legal documents, ensuring compliance with contractual obligations.
- Take initiative, work independently, and demonstrate accountability for processes and outcomes.
- Practice open, clear, and effective communication, building strong relationships with colleagues and business partners.
- Exhibit professionalism, integrity, and adaptability to changing environments while respecting confidentiality and data security.
